Authority be damned: The Obama administration has demanded that all public schools open all bathrooms to students based on their “gender identity” rather than their sex, even though the administration lacks the power to do so.
According to Reuters, the “guidance” was issued jointly by the Department of Education and the Department of Justice — a strong indication that the administration plans to sue jurisdictions that fail to comply.
The new guidelines would also prohibit schools from asking for a medical diagnosis or proof of any treatment for their gender identity claims, leaving any student able to pick the bathroom of their choice.
“There is no room in our schools for discrimination of any kind, including discrimination against transgender students on the basis of their sex,” Attorney General Loretta Lynch said in a statement. “This guidance gives administrators, teachers, and parents the tools they need to protect transgender students from peer harassment and to identify and address unjust school policies.”
“No student should ever have to go through the experience of feeling unwelcome at school or on a college campus,” Education Secretary John King Jr. said in a similar statement.
Notice one thing missing from these statements: any mention of student safety.
Even though we’ve documented numerous cases where sexual predators have used these bathroom policies for their own sick ends, the administration refuses to consider this danger to students.
They’ve already tried to take education funding away from North Carolina for its transgender bathroom law. It seems wholly likely, given Attorney General Lynch’s participation in the announcement of these standards, that they’re set to do that again, even though the government lacks the authority to do any of this.
The reason we have bathrooms for men and women isn’t because all of us cisgender-privileged people hate transgender individuals. It’s because sexual predators try to use bathrooms for their perverted desires.
That’s where you and your children rank with the Obama administration, folks. Safety is less important than the administration’s agenda, and the administration is willing to take away your community’s funding if they don’t agree.
