Gowdy to Comey: Help me understand, ‘what would Hillary have had to do’ to warrant prosecution?

Rep. Trey Gowdy implored FBI Director James Comey to explain his agency’s actions in refusing to prosecute Hillary Clinton for mishandling classified information when she was secretary of state.

“What would she have had to do to warrant your recommendation for prosecution?” the South Carolina Republican asked Comey during a House Oversight Committee hearing Wednesday. Gowdy wondered what other evidence was needed to prosecute Clinton if all that had been revealed in the federal investigation was not enough as he grilled Comey on the question of intent.

Comey noted that intent could be proved by looking at whether a person did something they knew was wrong at the time.

“But the way to prove that is whether or not someone took steps to conceal or destroy what they’ve done,” Gowdy declared. “That is the best evidence you have that they knew it was wrong, that they lied about it.”

Concluding his allotted time, Gowdy told Comey he had been “real careful not to criticize you” but he found it hard to understand the director’s decisions in the Clinton probe.

“That is not the FBI that I used to work with,” Gowdy said.
