Recently, critics have accused Republican presidential candidate Donald Trump of being racist over his comments about Judge Gonzalo Curiel, the Mexican-American federal judge presiding over the Trump University lawsuits.
Trump said Curiel should recuse himself from the cases because his immigration platform poses a fundamental conflict of interest.
While the left railed against Trump for his remarks, let us remind you of a matter concerning the Department of Justice and Judge A. Ashley Tabaddor, who is of Iranian descent.
The Justice Department first became concerned with what appeared to them as an “appearance of impropriety” after Tabaddor attended a 2012 White House meeting with other high-profile Iranian-Americans. Her superiors recommended she recuse herself from future cases involving Iranian nationals, and after the meeting, their recommendation became an order, according to NPR.
While immigration cases are generally assigned at random, judges are sometimes asked by the parties involved to recuse themselves if there appears to be a conflict of interest or bias, NPR host Richard Gonzales reported.
Tabaddor, who has been hearing immigration cases since 2005, sued President Barack Obama’s DOJ, claiming the order violated Tabaddor’s First Amendment rights.
Attorney Ira Kurzban pointed out during the interview with Gonzales that under the same logic African-American judges would not be able to hear cases involving people from Africa and Jewish judges would be ordered not to hearing cases involving Israelis.
It’s ridiculous, but then, that’s liberalism for you.
According to the judge’s lawsuit, “no one has accused her of bias,” Gonzales said. “Instead, Justice Department officials were concerned with the appearance of impropriety.”
Apparently, their concern was found to be overly excessive and the DOJ settled with Tabaddor in 2015 for $200,000 and promised to review its recusal policies.
Listen to the interview below.
It doesn’t take a genius to see the difference between the DOJ forcing someone to recuse herself because of her race from hearing a case to Trump simply suggesting it because of policy positions, but leave it to the left to cry racism if given half a chance.
